2. Applicability of the Terms and Conditions

These general terms and conditions apply to all offers, agreements, and deliveries of products by The Mirah Official via the website www.themirahofficial.com.
By placing an order on the website, the customer agrees to these terms and conditions.
Deviations from these terms and conditions are only valid if agreed upon in writing between The Mirah Official and the customer.
If any provision of these terms and conditions is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

3. Offer and Products

The Mirah Official offers handmade bags. Each product is handcrafted, which may result in slight variations in color, shape, and finish. These variations are inherent to handmade products and do not constitute grounds for complaints or returns.
Product photos and descriptions on the website are as accurate as possible, but deviations may occur. The images are illustrative and may differ in some cases from the delivered product.
If a product is no longer available, the customer will be notified promptly. If possible, a replacement product will be offered, or a refund will be provided.

4. Prices and Payments

All prices on the website are in euros and inclusive of VAT unless otherwise indicated.
Prices exclude shipping costs, which are clearly stated during the ordering process.
Payment methods available on the website include iDEAL, credit card, and PayPal. Customers are required to make payment at the time of ordering.
The Mirah Official reserves the right to adjust product prices at any time. However, the price applicable at the time of the order will remain binding.

5. Delivery and Performance

The Mirah Official aims to ship orders within 14 working days of payment receipt, unless a longer delivery period is specified. For handmade products, delivery times may be extended, in which case the customer will be notified.
Delivery takes place at the address provided by the customer, who is responsible for ensuring the accuracy of the address details.
If a product cannot be delivered on time, the customer will be informed and has the right to cancel the agreement free of charge. In such cases, The Mirah Official will refund the payment without unnecessary delay and no later than 14 days after cancellation.
The risk of damage or loss of products lies with The Mirah Official until the product is delivered to the customer or a previously designated representative, unless otherwise expressly agreed.

6. Right of Withdrawal

Customers have the right to withdraw from the agreement within 14 days without giving reasons. This withdrawal period expires 14 days after the customer or a third party, other than the carrier, receives the product.
To exercise the right of withdrawal, customers must notify The Mirah Official via an unequivocal statement (e.g., email) using the provided withdrawal form or a clear written request.
Products must be returned in their original condition and packaging within 14 days of withdrawal notification.
Return shipping costs are borne by the customer, unless otherwise agreed.
The right of withdrawal does not apply to:

  • Customized or personalized products specifically made to the customer’s specifications.

7. Complaints and Warranty

The Mirah Official strives to deliver high-quality products. Customers must report any complaints about products or services in writing within a reasonable period (maximum 30 days) after discovering the defect.
The Mirah Official will respond to complaints within 14 days of receipt. If a complaint requires more time, customers will be informed of the expected resolution time within this period.
Products are covered by the statutory warranty under Dutch law, which ensures that products meet the reasonable expectations of the agreement.
The warranty is void if:

  • The product is damaged due to improper use.

  • The customer fails to follow the product care instructions provided.

8. Liability

The Mirah Official is not liable for indirect damages, including consequential damages, lost profits, or missed savings, unless caused by intent or gross negligence.
Liability is always limited to the amount paid by the customer for the product in question.
The Mirah Official is not responsible for color deviations caused by the customer's screen settings.
This exclusion of liability does not apply in the event of death or personal injury caused by negligence on the part of The Mirah Official.

9. Force Majeure

The Mirah Official is not obliged to fulfill its obligations in cases of force majeure, which include circumstances beyond its reasonable control, such as natural disasters, pandemics, strikes, or transportation disruptions.
If a force majeure event lasts longer than 60 days, both parties have the right to terminate the agreement without the other party being entitled to compensation.

10. Dispute Resolution

These terms and conditions and all agreements are governed exclusively by Dutch law.
Disputes will preferably be resolved amicably. If this is not possible, disputes will be submitted to the competent court in the district where The Mirah Official is located.
Customers may also use the European Online Dispute Resolution (ODR) platform via the following link: https://ec.europa.eu/consumers/odr.

11. Privacy Policy

The Mirah Official respects the privacy of all website users and ensures the confidential treatment of personal data in accordance with the GDPR.
The following data may be processed:

  • Personal and contact information for order fulfillment.

  • Payment and transaction details.

  • Data collected for marketing purposes (only with prior consent). Customers have the right to access, correct, and delete their data. For more information, see the separate privacy statement available on the website.

12. Intellectual Property

All designs, images, and texts on The Mirah Official’s website are protected by intellectual property rights.
It is prohibited to copy, distribute, or otherwise use these materials without prior written consent from The Mirah Official.
Customers are granted a limited right to use the website for personal purposes only.

13. Additional Information

The Mirah Official is required to provide customers with a withdrawal form. This form will be made available to customers during the ordering process and can be downloaded from the website.
